These Terms of Service (“Terms”) govern your access to and use of draft. (“Service”). By creating an account or using the Service you agree to these Terms.

3. Eligibility

The Service is intended for professional users such as creators, businesses, and agencies. You must be at least 16 years old and have the legal right to manage and publish content to any connected social media account.

4. What the Service does

draft. lets you create, schedule and (optionally) auto-publish social posts, manage assets, and view analytics pulled from connected platforms (e.g. Instagram, Pinterest). Features may evolve over time.

5. Your Account & Security

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

6. Connected Platforms & Permissions

You may connect third-party platforms (e.g., Instagram via Meta). By connecting, you grant us permission to access the corresponding APIs and act per the scopes you authorize (e.g., read insights, create media containers, publish posts). You can revoke access at any time in the third-party platform’s settings. We do not control and are not responsible for changes, availability, or limitations of third-party platform APIs.

7. Your Content & License to Us

You retain all rights to content you upload or create. You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, adapt, and transmit your content solely to provide the Service (e.g., transcoding, scheduling, publishing, generating previews/analytics). You represent that you have all rights necessary to upload and publish the content and that it complies with applicable laws and third-party terms.

8. Acceptable Use

You agree not to: (a) violate laws or third-party rights; (b) upload illegal, infringing, or harmful content; (c) attempt to access others’ data; (d) interfere with the Service; (e) circumvent rate limits or platform policies. We may suspend or terminate access for violations.

9. Plans, Billing & Taxes (if applicable)

If you purchase a paid plan, you authorize us (or our payment processor, e.g., Stripe) to charge applicable fees and taxes. Unless stated otherwise, subscriptions renew automatically until canceled. You can cancel at any time; access continues until the end of the billing period. Refunds are governed by our refund policy (if provided).

10. Availability & Changes

We strive for high availability but do not guarantee uninterrupted service. We may change or discontinue features with reasonable notice where feasible.

11. Data Protection & Privacy

Our processing of personal data is described in our Privacy Policy (/privacy). By using the Service you agree to that policy.

12. Third-Party Services

Third-party services are governed by their own terms and policies (e.g., Meta/Instagram, Pinterest, Vercel, Supabase, Stripe). We are not responsible for those services.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or for security/legal reasons. Upon termination or account deletion, we will process your data in accordance with our Privacy Policy and our Data Deletion page (/data-deletion).

14. Disclaimers

The Service is provided “as is”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our aggregate liability is limited to the amounts you paid to us in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your breach of these Terms or applicable law.

17. Governing Law & Disputes

These Terms are governed by the laws of Germany (excluding conflict-of-law rules). Venue is Hamburg, Germany. Mandatory consumer rights remain unaffected.

18. Changes to these Terms

We may update these Terms. Material changes will be announced on the site or via email. Continued use after the effective date constitutes acceptance.
